1. Agreement to Terms

By accessing and using the Booker Texas website and services, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services or website.

2. Services Description

Booker Texas provides business marketing consulting and strategic growth planning services. Our services include Growth Strategy Consulting and Digital Visibility Planning as described on our website. All service descriptions, pricing, and timelines are estimates and may vary based on project scope.

Important: We do not guarantee specific business results, revenue increases, or other measurable outcomes. Our services provide strategic guidance and recommendations, but actual results depend on numerous factors outside our control, including market conditions, client execution, and external business factors.

3. Engagement Terms

Services are provided on a project basis unless otherwise agreed in writing. Each engagement begins with a proposal outlining scope, pricing, timeline, and deliverables. Services commence upon acceptance of the proposal and receipt of initial payment.

Payment terms are typically 50% upon project commencement and 50% upon delivery of final deliverables. Specific payment arrangements will be detailed in individual project proposals.

4. Client Responsibilities

Clients are responsible for providing timely access to necessary information, personnel, and materials required for service delivery. Clients must respond to requests for information within reasonable timeframes to avoid project delays.

Implementation of our recommendations remains the client's responsibility unless specifically contracted otherwise. We provide strategic guidance and planning but do not typically execute marketing campaigns or manage ongoing marketing operations.

5. Intellectual Property

Upon full payment, clients receive ownership of custom deliverables created specifically for their project, including strategy documents, frameworks, and analyses. However, Booker Texas retains ownership of our proprietary methodologies, processes, templates, and general knowledge.

Clients may not resell, redistribute, or claim authorship of our work. Materials may be used internally for the client's business purposes but not commercialized or shared with third parties without written permission.

6. Confidentiality

We maintain confidentiality of all client information shared during engagements. We do not disclose client identities, project details, or sensitive business information without explicit permission.

Clients agree to keep proprietary methodologies, processes, and frameworks confidential and not share them with third parties.

7. Limitation of Liability

Booker Texas's liability for any claims arising from our services is limited to the amount paid for those specific services. We are not liable for indirect, consequential, or incidental damages including lost profits, business interruption, or opportunity costs.

We make no warranties regarding specific outcomes or results from implementing our recommendations. Strategic consulting provides guidance and analysis, but business success depends on numerous factors beyond our control.

8. Termination

Either party may terminate an engagement with written notice. Upon termination, clients are responsible for payment for work completed to date. Any prepaid amounts for uncompleted work will be refunded on a prorated basis.

Booker Texas reserves the right to terminate engagements if clients fail to provide necessary cooperation, violate terms, or engage in unethical business practices.

9. Website Use

The Booker Texas website is provided for informational purposes. Content on the website, including articles and resources, is for general guidance only and should not be construed as specific advice for your situation.

By providing contact information, you consent to receive communications from Booker Texas regarding your inquiry or engagement. We do not sell or share contact information with third parties for marketing purposes.

11. Governing Law

These Terms and Conditions are governed by the laws of the Commonwealth of Massachusetts, United States. Any disputes will be resolved in the courts of Massachusetts.

12. Modifications to Terms

We reserve the right to modify these Terms and Conditions at any time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of our services after changes constitutes acceptance of modified terms.
